In the legal sense, a defect is a defect which renders the good unfit for its use or which diminishes its value. The buyer, if he had known about the problem, would not have bought the property or at least would not have paid the asking price.

More specifically, a latent defect is a defect that the buyer could not detect and of which he was not aware at the time of the sale. This is a serious construction defect which may impair the usefulness of the property concerned. Similarly, this latent defect depreciates the value of the property.

To engage the responsibility of the seller, several “proofs” must be entered in the file. Among other things, it must be proven that the defect existed at the time of the sale as opposed to a defect that could have appeared since the buyer became the owner. It is also necessary to demonstrate that the defect was "hidden" as opposed to an "apparent" defect.
